the principles of mediacy und immediacy in the main court hearing

Original title / Originaltitel Das Beweisverfahren der schweizerischen Strafprozessordnung im Hinblick auf die Prinzipien der Mittelbarkeit und Unmittelbarkeit im gerichtlichen Hauptverfahren
Summary / Zusammenfassung For the first time in modern Switzerland, a code of criminal procedure has been created for judging cases of general criminal law which is valid across the whole country and which puts an end to cantonally fragmented formal codes of procedure. This new Swiss code of criminal procedure contains norms pertaining to both immediacy and mediacy of evidentiary proceedings within the criminal trial.
In order to understand this differentiation between immediacy and mediacy in the main hearing, it is helpful to recall the following citation from probably the most famous German criminal defense lawyer of the Weimar Republic, Max Alsberg (1877-1933): "The rhythm of a speech not only conveys its truth content; it also enlarges upon it." Alsberg's statement outlines in clear language one of the central concerns of this manuscript: to analyze whether direct evidentiary proceedings within a criminal trial are superior to indirect evidentiary proceedings with regard to information gain or – formulated in Alsberg's terminology – whether they "enlarge upon the truth content". Pragmatic aspects, too, such as the possibility in direct evidentiary proceedings to question witnesses firsthand and in person, to ask follow-up questions, to draw their attention to possibly contradictory behavior, or – in very general terms – to expand the quantity of legally permissible facts and circumstances, will be analyzed regarding their additional information content.
Finally, this new method of organisation will also be examined with the "fair trial maxim" in mind and measured not only according to legal standards, but also to ethical and moral considerations.
